German Tax Law Leaves Status of Bitcoin to Wrapped Bitcoin Swaps Undecided
German tax authorities have not definitively clarified whether exchanging bitcoin for Wrapped Bitcoin triggers capital gains or restarts the one-year holding period.
Under German tax regulations, exchanging native Bitcoin for Wrapped Bitcoin (WBTC) remains subject to two conflicting interpretations. The core issue revolves around Section 23 of the German Income Tax Act, which treats privately held crypto assets as taxable private disposal transactions unless they are held for more than one year before disposal.
One legal interpretation views the conversion into WBTC as a disposal of the underlying asset, which immediately restarts the one-year holding clock. An alternative interpretation maintains that the economic identity of the holding is preserved because WBTC is an ERC-20 token backed 1:1 by real bitcoin held with a custodian, making the swap tax-neutral.
Neither the Federal Ministry of Finance nor the Federal Fiscal Court has issued definitive administrative guidance on the matter. In mid-October, approximately 116,100 WBTC were in circulation, representing more than $9.4 billion in value at prevailing market prices.
