Thailand Establishes Regulatory Framework for Spot Ether and Bitcoin ETFs

Thailand's Securities and Exchange Commission has approved 11 regulatory notices that permit spot Ether and Bitcoin exchange-traded funds to list on the Stock Exchange of Thailand starting October 16, 2026. The framework is designed to provide regulated digital asset access for institutional and retail investors under explicit risk controls.

Each eligible fund must exclusively track one cryptocurrency, either Ether or Bitcoin, and allocate an annual average of at least 80% of its asset value to the respective holding. All underlying digital assets must be held with local custodians certified by the Thai SEC, while fund operators must satisfy strict operational and staffing criteria.

The regulatory regime forbids brokerages from offering margin financing to crypto ETF investors. Domestic mutual and private investment funds will be authorized to allocate capital to Thai-listed crypto funds, although retail access to foreign-listed crypto ETFs remains restricted to institutions and ultra-high-net-worth investors. The SEC clarified that specific ETF product applications have not yet been approved.
