Thai SEC Opens Consultations on Bitcoin and Ether ETF Regulations
Thailand's securities regulator has launched public consultations establishing rules for spot Bitcoin and Ether exchange-traded funds and foreign custodians.
The Securities and Exchange Commission of Thailand launched two public consultations on August 24, setting out proposed operating rules for locally listed Bitcoin and Ether exchange-traded funds (ETFs) alongside standards for foreign digital asset custodians. The consultation period is scheduled to conclude on September 20.
Under the proposed framework, eligible ETFs must be passively managed, traded exclusively on the Stock Exchange of Thailand (SET), and maintain an average net exposure of at least 80% to the underlying cryptocurrency across the accounting year. Due to liquidity considerations, the Thai SEC has limited the initial scope to Bitcoin and Ether. Fund managers will also be required to prove adequate operational systems and qualified personnel before receiving approval.
The latest proposals build on an initial framework presented in April, which drew broad market support while prompting the regulator to revise its stance on custody rules following industry feedback. In addition, the regulator continues to examine mechanisms for dedicated market makers to support product liquidity once trading begins.
